1. Introduction

These Terms and Conditions (“Terms”) govern the use of all websites, services, products, and software provided by Card Concepts Merchant Services, Inc. (“Card Concepts,” “we,” “us,” or “our”), including:

  • The main website at www.cardconceptsinc.com;

  • The client portal and CRM system located at app.cardconceptsinc.com; and

  • Any merchant service, payment processing, or customer support provided by Card Concepts.

By accessing or using any of our services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.


2. Company Information

Card Concepts Merchant Services, Inc. is a registered Independent Sales Organization (ISO) of PNC Bank, N.A., Pittsburgh, PA. We provide merchant payment processing, POS equipment, and related services through our financial and technology partners, including Authorize.net, NMI, and PNC Bank.

Our CRM and communication systems are powered by GoHighLevel, operated under our white-label platform at app.cardconceptsinc.com, utilizing LeadConnector, Mailgun, and Twilio for automation, email, and SMS delivery.


3. Eligibility

Our services are intended for lawful business use by individuals or entities legally capable of entering binding contracts. You must be at least 18 years old to use our Services.


4. Scope of Services

Card Concepts provides two primary categories of service:

A. Merchant Services
Includes payment processing, equipment leasing or purchase, gateway setup, and related financial support services. All merchant accounts are subject to approval by our banking partners and may require separate application and agreement.

B. CRM and SaaS Services
Includes access to our proprietary white-labeled platform at app.cardconceptsinc.com, featuring customer management, marketing automation, and communication tools. CRM access requires an active subscription and may be governed by additional agreements or terms provided within the platform.


5. Account Registration and Access

To use our CRM or merchant portal, you must register for an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

We reserve the right to suspend or terminate access to any account for misuse, unauthorized activity, or violation of these Terms.


6. Acceptable Use Policy

You agree not to use our services for any unlawful or harmful purpose, including but not limited to:

  • Engaging in fraud, money laundering, or deceptive practices

  • Sending unsolicited or spam messages through CRM systems

  • Violating A2P 10DLC, TCPA, CAN-SPAM, or related communications laws

  • Interfering with or attempting to breach the security of our systems

Violation of this policy may result in immediate suspension or termination of services.


7. Fees and Payment

All fees are clearly outlined in your merchant agreement or CRM subscription plan.

Merchant Services:
Processing and equipment fees are billed in accordance with the applicable merchant agreement. Fees are non-refundable once processing has commenced.

CRM Subscriptions:
CRM subscriptions are billed monthly or annually. Cancellation requires written notice at least 30 days prior to the next billing date. Once a billing cycle has begun, fees are non-refundable.

Invoices not paid when due may result in suspension or termination of access.


8. Refund and Cancellation Policy

Merchant Services:
Setup fees, transaction fees, and monthly account fees are non-refundable once services have been activated. Equipment returns may be subject to restocking fees as specified in your merchant agreement.

CRM Subscriptions:
Clients may cancel their CRM subscription with 30 days’ written notice before the next billing cycle. Cancellations received after the billing date will apply to the following cycle. Partial refunds are not issued for unused time.


9. Communication and Marketing

By submitting your contact information through our website or CRM, you consent to receive communications by phone, email, and SMS.

  • Message frequency varies.

  • Standard messaging and data rates may apply.

  • You may opt out at any time by replying STOP or following the unsubscribe link in any email.

We comply with TCPA and A2P 10DLC requirements for registered campaigns and do not sell personal data.


10. Intellectual Property

All content, software, trademarks, and branding on our website and CRM are owned by Card Concepts Merchant Services, Inc. or its licensors. You may not copy, modify, or distribute our materials without written permission.

CRM users retain ownership of their business data and customer information but grant Card Concepts a limited license to process and store such data for service delivery.


11. Disclaimer of Warranties

All services are provided “as is” and “as available.” Card Concepts makes no warranties, express or implied, regarding the reliability, availability, or fitness of the Services for any particular purpose.

We do not guarantee uninterrupted service or that all errors will be corrected.


12. Limitation of Liability

To the fullest extent permitted by law, Card Concepts, its affiliates, officers, and employees shall not be liable for:

  • Any indirect, incidental, special, or consequential damages;

  • Any loss of profits, revenue, or data arising from the use or inability to use our Services;

  • Any errors, delays, or failures beyond our reasonable control.

Our total liability for any claim shall not exceed the total amount paid by you to Card Concepts in the 12 months preceding the claim.


13. Indemnification

You agree to indemnify and hold harmless Card Concepts Merchant Services, Inc., its partners, and affiliates from any claims, damages, or expenses resulting from your use of the Services, violation of these Terms, or infringement of third-party rights.


14. Third-Party Services

Certain portions of our services rely on third-party providers such as Authorize.net, NMI, GoHighLevel, Twilio, and Mailgun. Your use of those integrations is also subject to their terms of service and privacy policies. We are not responsible for the actions or policies of these entities.


15. Termination

We may terminate or suspend access to our Services at any time, without prior notice, for breach of these Terms or for conduct that may harm our reputation or operations.

Upon termination, all rights granted to you under these Terms will cease immediately.


16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of laws principles.


17. Updates to These Terms

We may update these Terms periodically. The latest version will always be available at www.cardconceptsinc.com. Continued use of the Services after updates constitutes acceptance of the revised Terms.
